These terms and conditions for using the VNFITE application constitute a legal, binding and enforceable Agreement between the User and VNFITE Financial Technology Joint Stock Company (Business Code: 0109423042) (call “Company” or “VNFITE”). I. INTRODUCTION TO VNFITE APPLICATION

“VNFITE Application” is a collection that includes but is not limited to: Applications, Websites, Software Programs, and Databases of VNFITE to connect and support financial services and investment consulting according to the model.   2. Investor: Are individuals, businesses, or business households that need to call for capital (mobilize investment capital), through using the VNFITE Application to post information about the need to call for capital for business, consumption, or other purposes.   3. Electronic investment consulting service contract : Is a contract signed in the form of an electronic contract between the Investor and VNFITE whereby VNFITE will advise the Investor in capital investment and provide services according to Monitor, notify and support to remind investors to pay principal and interest according to the signed "Electronic investment capital management and consulting contract".
  4. Electronic investment capital management and consulting contract: A contract signed in the form of an electronic contract between the Investor and the Investor, whereby the Investor will fund part or all of the Note number according to needs of the Investor to serve business or consumption activities. VNFITE provides connection and support services for "Investors" and "Investment Recipients" in the territory of the Socialist Republic of Vietnam. These terms and conditions apply to all members/users using services on the VNFITE application provided in the territory of Vietnam.

IV. USER'S SUBJECT CAPACITY

Conditions to be able to register an account and use services on the VNFITE application are Vietnamese citizens at least 18 years old, to ensure that Users have full civil act capacity and are responsible for themselves. about any behavior or transaction performed by the User on the VNFITE application.

V. PROVIDING INFORMATION

When creating an account and using the VNFITE application, members/users need to provide honest and accurate personal information, including but not limited to information about full name and identity card number. /passport/citizen identification card (original issued by the competent authority, photocopy), email, place of permanent residence, age, contact phone number, job (for users who are individuals) core); or number, date of issue, place of issuance of business registration certificate, establishment and operation license (for organizational users). BECAUSE. ACCOUNT ACCESS AND SECURITY

  1. To use services on the VNFITE application, users need to register to create their own account.   2. Users are fully responsible for monitoring their accounts and transactions and must immediately notify VNFITE in writing/phone/email if the member/user knows or suspects that:

Users must be responsible for all transactions, instructions/orders made through the VNFITE application using the user's account/username and password and bear the costs incurred by related parties. VII. INTELLECTUAL PROPERTY RIGHTS

  1. Trademarks, trade names, logos, content and other information, images and videos displayed on the VNFITE application are owned by VNFITE or VNFITE's partners. VIII. TRADING ON VNFITE APPLICATION

To perform all transactions and services on the VNFITE Application, users need to perform and comply with the following basic instructions:

Users need to download the VNFITE application, register and log in to an account on the VNFITE Application to submit online documents to VNFITE. VNFITE is not required to perform confidentiality obligations as prescribed in this Terms and Conditions for the following information:

  1. Violation of information security obligations

In case one party violates the information security obligation and causes damage to the other party, that party is responsible for compensating the other party for the damage according to the actual damage value, including direct damages. to which the aggrieved party would have been entitled had there not been a breach. X. HANDLING OF VIOLATIONS

In case a member/user violates any content in the Terms and Conditions of use of this service, VNFITE has the right to lock the account, or lock access to the account/application, or lock certain numbers. transaction features/service usage of that member/user. Locking an account or access rights does not terminate the financial obligations that members must perform with VNFITE or with other members/users. XI. RISK

  1. Consequences caused by risks

  2. Members can access the VNFITE application but the transactions made or given by the member/user do not receive approval or permission from VNFITE;
  3. Member/user has lost or misappropriated temporary data, passwords, confidential information or other information personally or commercially;
  4. Other consequences (if any).
  1. User consent

Although VNFITE will always make every effort to ensure and upgrade the system to operate correctly, preserve data, transaction information and user information, it will not be possible to anticipate all risk cases. Force majeure risks may occur. Therefore, members/users understand and agree that when members/users use the VNFITE application provided by VNFITE, members/users are fully aware of the risks that may arise from such use. XII. RIGHTS AND OBLIGATIONS OF VNFITE

XIII. RIGHTS AND OBLIGATIONS OF MEMBER/USER

  1. Obligations and responsibilities of members/users

    11. Comply with legal regulations on payment, advertising, promotion, intellectual property rights protection, consumer rights protection and other relevant legal regulations when making transactions via VNFITE application ;
    12. Commit and agree not to use VNFITE's services for illegal purposes such as crime, money laundering, tax evasion, fraud, threats, illegal information exploration, sabotage, creation and distribution. spreading viruses that damage VNFITE's system, configuration, and information transmission;
    13. Commit not to change, modify, copy, propagate, distribute, provide and create similar tools of the service provided by VNFITE to a third party without VNFITE's consent;
    14. Do not act to discredit VNFITE in any form, including but not limited to, causing disunity among members/users by using a second registered name, through a third party, or propagate or disseminate incorrect information, negatively affecting VNFITE's reputation.

XIV. ELECTRONIC SIGNATURE

If any complaints or disputes arise, the Parties must promptly notify each other and actively discuss and resolve them on the basis of negotiation, equality, cooperation, and mutual benefit. If the Parties cannot negotiate or conciliate themselves to resolve the dispute, they will invite a third party, a commercial mediator or lawyer, to mediate the arising dispute;

In case the Parties in the dispute cannot resolve the dispute through negotiation within 90 days from the date the dispute arises, the Parties have the right to bring the dispute to resolution at the District People's Court. , where VNFITE's headquarters is located. XVIII. AMENDMENTS AND SUPPLEMENTS
